This Privacy Policy (“Policy”) explains how Tervio LLC (“Tervio,” “we,” “us,” or “our”) collects, uses, discloses, and protects personal information when you access or use our websites, SaaS platform, applications, and related services (collectively, the “Services”). By using the Services, you acknowledge and agree to the practices described in this Policy.

 

Scope of This Policy

This Policy applies to personal information we collect from customers, Authorized Users, website visitors, and prospective customers. It does not apply to information that our customers upload to the TERVIO-Platform on behalf of their own users — that data is governed by our agreement with the relevant customer. 1.  Information We Collect

1.1  Information You Provide Directly

We collect information you provide when you create an account, subscribe to the Services, or communicate with us, including:

  • Contact information: name, email address, phone number, and mailing address
  • Account credentials: username, password (stored in hashed form), and security settings
  • Payment information: billing address and payment method details (processed by our PCI-compliant payment processor; Tervio does not store full card numbers)
  • Professional details: job title, company name, and role
  • Communications: support requests, survey responses, event registrations, and feedback you submit

1.2  Information We Collect Automatically

When you use the Services, we automatically collect technical and usage data, including:

  • Device information: IP address, browser type and version, operating system, and device identifiers
  • Usage data: pages visited, features used, search queries, clickstream data, and session duration
  • Location data: general location derived from your IP address
  • Log data: access times, errors, and events generated during your use of the platform

1.3  Information from Third Parties

We may receive information about you from third-party sources, including:

  • Social media platforms linked to our Services
  • Business partners and data enrichment providers
  • Publicly available databases and professional directories

 

We combine information from different sources to create a more complete profile and to improve the relevance and quality of our Services.

We do not use or disclose sensitive personal information for purposes other than those permitted by applicable law.

3.  How We Share Your Information

3.1  Service Providers

We share personal information with third-party vendors who perform services on our behalf, such as payment processing, cloud infrastructure, email delivery, analytics, and customer support tools. These providers are contractually bound to use information only as directed by Tervio.

3.2  Affiliated Entities

We may share limited administrative and billing information with our corporate affiliates and parent company. We do not share Customer Data with affiliates without your explicit authorization.

3.3  Business Transfers

In the event of a merger, acquisition, sale of assets, or similar corporate transaction, your information may be transferred as part of that transaction. We will provide notice before your information becomes subject to a materially different privacy policy.

3.4  Legal Requirements

We may disclose personal information if we believe in good faith that such disclosure is necessary to: (a) comply with a legal obligation or respond to lawful government requests; (b) protect the rights, property, or safety of Tervio, our customers, or the public; or (c) enforce our agreements and policies.

3.5  We Do Not Sell Personal Information

Tervio does not sell, rent, or trade your personal information to third parties for monetary consideration. We may share personal information with additional third parties when you have provided your explicit consent to such sharing.

4.  Data Retention

We retain personal information for as long as your account is active, as necessary to provide the Services, or as required by applicable legal obligations. Retention periods are determined based on:

  • The nature and sensitivity of the information
  • The purpose for which the information was collected
  • Our legal and regulatory obligations (e.g., tax, accounting, compliance records)
  • Our legitimate business interests such as resolving disputes and enforcing agreements

 

Upon account termination, we will delete or anonymize your personal information within ninety (90) days, unless retention is required by law or legitimate business necessity. Customer Data export requests must be submitted within thirty (30) days of termination.

 

5.  Data Security

Tervio implements industry-standard technical and organizational measures to protect your personal information, including:

  • Encryption in transit (TLS) and at rest (AES-256)
  • Role-based access controls (RBAC) and Multi-Factor Authentication (MFA)
  • Network security monitoring, DNS filtering, and intrusion detection
  • Data masking and anonymization techniques for analytics use cases
  • Regular security assessments and vulnerability management

 

Security Notice

While we take strong measures to protect your information, no method of internet transmission or electronic storage is 100% secure. We cannot guarantee absolute security, and you share information with us at your own risk. Please promptly report any suspected security incidents to security@tervio.com.

 

6.  Your Privacy Rights & Choices

6.1  Universal Rights

Regardless of your location, you have the following rights:

  1. Opt-Out of Marketing: Unsubscribe from promotional emails at any time using the unsubscribe link in any marketing message. Transactional messages cannot be opted out of while your account is active.
  2. Cookie Preferences: Manage cookie and tracking preferences via our cookie consent manager or your browser settings.
  3. Account Information: Access and update your account information at any time by logging into your account settings.

6.2  Rights for U.S. Residents (California, Virginia & Other States)

If you reside in California, Virginia, Colorado, Connecticut, or other states with comprehensive privacy laws, you have additional rights including:

  • Access: Request information about the categories and specific pieces of personal information we hold about you
  • Correction: Request correction of inaccurate personal information
  • Deletion: Request deletion of personal information we have collected, subject to certain legal exceptions
  • Portability: Receive a copy of your personal information in a structured, machine-readable format
  • Opt-Out of Sale/Sharing: Opt out of the sale or sharing of personal information for targeted advertising purposes
  • Non-Discrimination: We will not discriminate against you for exercising any of your privacy rights

 

To submit a privacy rights request, email legal@tervio.com. We will respond within 45 days (extendable to 90 days with notice). We may need to verify your identity before fulfilling a request.

6.3  Rights for International Users (EEA/UK/Switzerland)

If you are located in the European Economic Area, United Kingdom, or Switzerland, you have rights under GDPR or applicable equivalents, including the right to: access, rectify, erase, restrict, or port your personal information; object to processing; and lodge a complaint with your local supervisory authority.

 

Where required, we rely on the following legal bases for processing: (a) contractual necessity; (b) legitimate interests; (c) legal obligation; and (d) your consent.

 

7.  California-Specific Disclosures

7.1  Categories of Personal Information Collected (CCPA)

In the preceding 12 months, we have collected the following categories of personal information as defined by the CCPA:

  • Identifiers (name, email, phone, IP address, account ID)
  • California Customer Records (name, address, payment information)
  • Commercial information (transaction history, subscription details)
  • Internet / network activity (browsing history, interactions with our platform)
  • Geolocation data (general location from IP address)
  • Professional or employment-related information (job title, company name)
  • Sensory data (audio/video recordings for support and training purposes)
  • Inferences drawn from the above categories

7.2  CCPA Opt-Out Rights

You may opt out of the sale or sharing of your personal information (including for interest-based advertising) at any time by: (a) clicking “Your Privacy Choices” in our website footer; (b) enabling a Global Privacy Control (GPC) signal in your browser; or (c) emailing legal@tervio.com.

7.3  Shine the Light

Tervio does not disclose personal information to third parties for their own direct marketing purposes. California residents may request information about this practice once per year by contacting us at legal@tervio.com.

7.4  Sensitive Personal Information

We collect account login credentials and payment information that constitute Sensitive Personal Information under the CCPA. We use this information only as necessary to deliver the Services and do not use it to infer characteristics about individuals.

 

8.  Third-Party Links & Services

The Services may contain links to third-party websites, integrations, or services that are not operated by Tervio. We are not responsible for the privacy practices of third parties. We encourage you to review the privacy policies of any third-party services you access through or in connection with our Services.

 

9.  Changes to This Policy

We may update this Privacy Policy from time to time. We will notify you of material changes by posting the updated Policy on our website with a revised effective date and, where required by law, by providing direct notice (e.g., by email). Your continued use of the Services after the effective date of any changes constitutes your acceptance of the revised Policy.
